1. Agreement to Terms

By accessing or using Shirimono ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Shirimono is operated and provided by us ("we," "our," or "us") at https://shirimono.fun.

2. Description of Service

Shirimono is an online platform for learning Japanese that uses a Spaced Repetition System (SRS) to help users learn and retain kanji, vocabulary, and grammar. The Service includes:

• Access to learning materials including kanji, vocabulary, and grammar lessons
• Spaced repetition review system to optimize learning retention
• Progress tracking and analytics
• Course enrollment and learning paths
• Premium features available through paid subscriptions

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You can create an account by providing your email address and creating a password, or by using Google OAuth authentication.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate, current, and complete information when creating your account
• Maintain and promptly update your account information
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

4. Subscription Plans and Payments

4.1 Subscription Plans

We offer the following subscription plans:

• Free Plan: Limited access to learning materials and features
• Monthly Plan: Full access to all features for ¥900 per month
• Yearly Plan: Full access to all features for ¥9,000 per year (equivalent to ¥750 per month)

4.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you agree to pay the applicable subscription fees. All fees are charged in Japanese Yen (JPY) and are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period, and you will continue to have access to premium features until that time.

4.4 Plan Changes

You may upgrade or downgrade your subscription plan at any time. When upgrading, you will be charged a prorated amount for the remainder of your current billing period. When downgrading, the change will take effect at the end of your current billing period.

4.5 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds in exceptional circumstances at our sole discretion. If you believe you are entitled to a refund, please contact us at tony.duong.102@gmail.com.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems (bots, scrapers, etc.) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Use the Service to transmit any malicious code, viruses, or harmful data
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality are owned by Shirimono and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you create or submit through the Service (such as notes or progress data). By using the Service, you grant us a license to use, store, and process your content solely for the purpose of providing and improving the Service.

6.3 Third-Party Content

The Service may include content from third parties, including AI-generated content. Such content is provided for educational purposes and may be subject to additional terms and conditions.

7. Service Availability

We strive to provide reliable service, but we do not guarantee that the Service will be available at all times or free from errors, interruptions, or security vulnerabilities. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Perform maintenance and updates that may temporarily interrupt service
• Restrict access to the Service for users who violate these Terms

8. Disclaimers and Limitation of Liability

8.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIRIMONO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

8.3 Educational Purpose

While we strive to provide accurate and helpful learning materials, we do not guarantee specific learning outcomes. Your progress depends on various factors including your dedication, study habits, and individual learning capabilities.

9. Indemnification

You agree to indemnify, defend, and hold harmless Shirimono and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Governing Law and Dispute Resolution
